What Stays with the House? - Inclusions & Exclusions in Real Estate

Inclusions and exclusions in real estate transaction in Colorado can be a "hot button" topic.  It along with property defects are the two largest areas we see people and brokers get sued over.  By having a good understanding of how the state approved contract is set-up and the general expectations, we can save ourselves a big headache at closing.

The big concern is if the items are ATTACHED.  If you need a tool to remove it, it's attached. IF you could pick the house up and shake it upside down, then everything that wouldn't fall is attached.  The standard contract states that the following items are specifically included unless referenced under Exclusions:

Lighting, heating, plumbing, ventilating and air conditioning fixtures, TV antennas, inside telephone, network and coaxial (cable) wiring and connecting blocks/jacks, plants, mirrors, floor coverings, intercom systems, built-in kitchen appliances, sprinkler systems and controls, built-in vacuum systems (including accessories), garage door openers

Additionally, the following are considered "Personal Property" and are included unless specifically referenced under the Exclusions:

Storm windows, storm doors, window and porch shades, awnings, blinds, screens, window coverings, curtain rods, drapery rods, fireplace inserts, fireplace screens, fireplace grates, heating stoves, storage sheds and all keys.

For Sellers: The best practice is if you really want an item to be excluded, replace it prior to marketing your home. Don't even give buyers a chance to fall in love with it. 

For Buyers: Be very specific and explicit in your purchase agreement if you want something included.  Don't leave anything to chance.
